Hybrid Working Model and Personnel Files

Hybrid working is an increasingly popular model in the modern business world. Especially during the pandemic period, many companies have experienced remote work and shifted towards the hybrid working model. In this model, employees can perform certain tasks at the office while completing other tasks remotely, at home or elsewhere. In this sense, it can be described as a combination of on-site physical work and remote work. However, many employers may fail to reflect the transition to hybrid work effectively in their employees’ personnel files and this seemingly insignificant issue is considered a substantial change in the employment contract, as regulated in Article 22 of the Labor Law, and may lead to the termination of the employee’s contract for just cause.
The most important aspects to consider in the personnel file for hybrid working model are as follows:
• Hybrid Working Conditions: The date when the employee was hired under the hybrid working model and when the transition to this work arrangement occurred should be specified. The terms and conditions of hybrid working between the employer and employee should be clearly stated in the employment contract and recorded in the personnel file.
• Working Hours: The on-site and remote working hours for the employee in hybrid work should be clearly stated in the personnel file, including weekly and daily working hours.
• Compensation and Benefits: Details of compensation and other benefits (e.g., travel expenses) related to the hybrid work arrangement should be accurately recorded in the personnel file.
• Occupational Health and Safety: Measures taken for the employee’s occupational health and safety in the hybrid work arrangement should be documented in the personnel file, covering both the office environment and remote work conditions.
• Data Security and Confidentiality: Policies and guidelines related to data security and confidentiality in hybrid work should be included in the personnel file. Employees should be informed about how to protect company data and ensure confidentiality.
As we have previously emphasized in other articles, the personnel file is an essential document containing the rights and responsibilities of both the employer and the employee. When transitioning to the hybrid working model, updating the personnel file with relevant information is crucial. Additionally, to ensure the company complies with employment laws regarding hybrid work, necessary legal arrangements should be included in the personnel file.
